What is Nursing Home Abuse?

In Illinois, there is a very specific legal definition of nursing home abuse under Health Facilities and Regulation (210 ILCS 45/) Nursing Home Care Act:

  • Sec. 1-103. Abuse. “Abuse” means any physical or mental injury or sexual assault inflicted on a resident other than by accidental means in a facility.

It’s important to understand that this abuse can come from staff, management, another resident, or another person not connected with the facility such as the family member of another resident or a contractor working onsite. Regardless, it is the responsibility of the nursing home to keep your loved one safe from all instances of abuse.

There are other ways a nursing home, its staff, or other people can mistreat residents. Theft is a major problem including theft of cash from the resident’s room, theft of credit card information, unauthorized bank withdrawals, and theft of jewelry and other valuables. In 2019, the Chicago-Times reported how staff at a Lincoln Park nursing home stole over $700,000 from one resident and even locked her in a room to keep her from leaving.

Although Illinois law may not legally recognize these examples as “nursing home abuse,” they are still criminal acts for which your loved one can seek compensation and justice.

What is Nursing Home Neglect?

Similarly, the Health Facilities and Regulation (210 ILCS 45/) Nursing Home Care Act has a specific definition of nursing home neglect:

  • Sec. 1-117. Neglect. “Neglect” means a facility’s failure to provide, or willful withholding of, adequate medical care, mental health treatment, psychiatric rehabilitation, personal care, or assistance with activities of daily living that is necessary to avoid physical harm, mental anguish, or mental illness of a resident.
